If you’re planning any renovations to your apartment, duplex, or other strata property, it’s essential to be aware of the rules and requirements involved.
All building and renovation work within a strata building must:
- Be carried out safely
- Comply with current building standards and regulations
These measures protect the interests of builders and owners alike, while helping to minimize the risk of defects and costly issues in the future.
Under the legislation, all Class 2 building projects need to comply with the new requirements. A Class 2 building is an apartment building or a building that contains two or more sole-occupancy units, with each sole- occupancy unit being a separate dwelling
Special Considerations for Strata & Class 2 Buildings
Renovating a unit, duplex, or apartment, please ensure:
- Strata approvals are obtained
- Licensed professionals are used
- Compliance with Design & Building Practitioners Act 2020 (NSW)
- Projects include regulated designs by a Registered Design Practitioner and are overseen by a Registered Building Practitioner
To make sure all work is safe and up to standard:
- A registered design practitioner must prepare regulated designs.
- A registered building practitioner must oversee the work
Penalties
Any practitioner failing to make a declaration or who makes a declaration when unregistered will face a maximum penalty of
$165,000 as a body corporate
$55,000 in any other case.
A Practioner who knowingly is aware of false or misleading declaration will face a maximum penalty of
$220,000 and/or two years imprisonment
